1. Acceptance of Terms

By downloading, installing, or using Extra Hands CPR Assistant ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

2. Description of Service

Extra Hands CPR Assistant is an educational tool designed to assist trained medical professionals during adult out-of-hospital cardiac arrest situations. The App provides:

• Metronome guidance for chest compressions
• CPR cycle timing and tracking
• Event logging capabilities
• Summary report generation
• Visual and audio cues for CPR procedures

3. Intended Users

This App is designed exclusively for:

• Certified healthcare providers (EMTs, Paramedics, Nurses, Physicians)
• Professional emergency responders
• Medical students and trainees under appropriate supervision
• Individuals with current CPR certification and training

The App is NOT intended for use by untrained individuals or for pediatric resuscitation.

4. Educational Tool Disclaimer

Extra Hands CPR Assistant is an educational assistance tool and is NOT a medical device. The App:

• Does not diagnose, treat, cure, or prevent any disease
• Does not provide medical advice or recommendations
• Is not FDA-cleared or approved as a medical device
• Should not replace proper medical training or certification
• Should not be relied upon as the sole source of guidance during emergency situations

5. Independent Development

Extra Hands CPR Assistant is independently developed by iHarig LLC and is not affiliated with, endorsed by, or sponsored by:

• American Heart Association (AHA)
• Global Resuscitation Alliance
• Resuscitation Academy
• Any other medical organization or institution

While the App incorporates evidence-based recommendations from published resuscitation guidelines, it is an independent implementation created for educational purposes.

6. User Responsibilities

By using the App, you agree to:

• Maintain current CPR certification and training
• Follow your organization's protocols and medical direction
• Use your professional judgment and training in all situations
• Not rely solely on the App during emergency situations
• Verify all information and recommendations against current guidelines
• Comply with all applicable laws, regulations, and organizational policies
• Handle any patient data in accordance with HIPAA and privacy regulations

7. Local Protocols

Users must follow their local protocols and medical direction at all times. The App's default settings follow general resuscitation guidelines, but users are responsible for adjusting settings to match their specific protocols and obtaining appropriate authorization from their medical director.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
• iHarig LLC disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement
• iHarig LLC shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages
• iHarig LLC does not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components
• Your use of the App is at your own risk

9. Indemnification

You agree to indemnify, defend, and hold harmless iHarig LLC from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms of Service
• Your violation of any rights of another party
• Any actions taken based on information from the App

10. No Medical Advice

The App does not provide medical advice. All content and functionality is for educational and informational purposes only. Always seek the advice of qualified healthcare professionals with questions regarding medical conditions or treatment.

11. No Guarantee of Accuracy

While iHarig LLC strives for accuracy, we do not guarantee that the App's content, timing, or functionality is error-free or current. Medical guidelines and recommendations evolve, and users are responsible for staying current with the latest evidence-based practices.

12. Modifications to Service

iHarig LLC reserves the right to modify, suspend, or discontinue the App at any time without notice. We may also modify these Terms of Service at any time by posting updated terms. Your continued use of the App constitutes acceptance of modified terms.

13. Third-Party Resources

The App may reference or link to third-party resources, websites, or guidelines. iHarig LLC is not responsible for the content, accuracy, or availability of these third-party resources.

14. Data and Privacy

Please refer to our Privacy Policy for information about how we handle data. Users are responsible for complying with HIPAA, patient privacy laws, and their organization's policies when using the App with patient information.

15. Professional Judgment

Nothing in the App is intended to replace or supersede your professional medical judgment, training, or certification. The App is a tool to assist trained professionals, not to replace their expertise or decision-making.

16. No Emergency Services

The App does not connect to or contact emergency services (911/112/etc.). Users must activate emergency medical services through appropriate channels independent of the App.

17. In-App Purchases

The App is free to download and use, with all features included. The only available in-app purchase is the optional Tip Jar.

• Tip Jar (Consumable): Optional one-time payments in small, medium, and large tiers to support independent development. Tips do not unlock any features. Current pricing in your local currency is shown on the App Store or Google Play before purchase.

Refunds: Refund requests for tip-jar purchases are handled by Apple or Google per their respective refund policies. iHarig LLC does not process App Store or Google Play refunds directly. You can request a refund through:

• Google: Google Play refund support

Tax: Prices shown are in US dollars and may not include applicable sales tax or VAT. Taxes are calculated and collected by Apple or Google per their regional policies.

18. Cross-Platform Data Sharing

The App provides features that allow Pro users to export and import data between devices. This includes CSV exports, JSON crew and agency exports, PDF case summaries, and Extra Hands container files (.extrahands) that bundle agency configuration, crew roster, case history, agency logos, and Pro Library documents.

When you export data from the App, you are solely responsible for:

• What data you include in the export
• Where and to whom you send the exported file
• Compliance with applicable patient-data, privacy, and intellectual-property regulations
• Any third-party copyright or licensing terms for PDFs you add to your Pro Library and subsequently share

When you import data shared by another user, the App shows a preview dialog listing what will be added or updated before writing anything. By confirming the import, you accept the imported data into your device's local storage. You are responsible for verifying that imported data is appropriate for your use and does not violate your organization's policies.

iHarig LLC has no visibility into exported files after they leave the App through your action, and no visibility into the content of imported files before or after import. iHarig LLC is not a party to, and bears no responsibility for, the accuracy, completeness, legality, or appropriateness of data that Pro users share with one another.

19. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles.

20. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

21. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and iHarig LLC regarding use of the App.
